1. WHO WE ARE

1.1. BUILDinvest, Tuukri tn 19-315, 10120 Tallinn, Estonia ("we", "BUILDinvest") operates the BUILDinvest game and the website buildinvest.online. You can reach us through the contact form at buildinvest.online/contact or through Support - Contacts in the app.

1.2. These Terms govern the contract between you and us for the use of the game. How we process personal data is described in the Privacy Policy at buildinvest.online/privacy_policy.

1.3. We act as a trader. If you use the game outside your trade, business or profession, you are a consumer: the mandatory consumer rights of European Union law and of the country you live in apply in addition to these Terms and are not limited by them.

2. THE CONTRACT

2.1. The contract is concluded when you register an account and accept these Terms.

2.2. You must be at least 18 years old and have full legal capacity. We may ask you to prove your age.

2.3. One person - one account. The account is personal; it may not be sold, rented, lent or transferred.

2.4. The game is entertainment. It brings no income, no investment return and no ownership of anything outside the game. Buildings, silver, licences, credits and all other game elements exist only inside the game.

3. SILVER AND GAME ITEMS

3.1. Silver is the internal unit of the game. You receive a personal, revocable, non-transferable right to use it inside the game. Silver is not electronic money, not a payment instrument, not a security and not a crypto-asset, and you acquire no property right in it.

3.2. We issue silver and may change its price, the in-game rates and its uses for the future. Such changes never take away silver that is already in your account.

3.3. Current in-game rates: collected profit is sold at 100 collected units = 1 silver, credited half to the purchase budget and half to the payout balance; balance exchange adds 20 %; the payout rate is 8 000 silver = 1 USD. The rate in force is always shown on the screen where you use it.

4. PURCHASES, PRICES, PAYMENT

4.1. Silver packs are sold as in-app purchases through Apple's App Store (on Android, through Google Play). The store is the seller of record. The price shown at the moment of purchase includes VAT and is charged by the store through the payment method in your store account.

4.2. Silver is credited after our server has verified the store receipt. If a receipt cannot be verified, nothing is credited and you should request a refund from the store.

4.3. Refunds of store purchases are handled by Apple or Google under their own rules. Your statutory rights under sections 5 and 10 are not affected.

5. RIGHT OF WITHDRAWAL (CONSUMERS IN THE EU)

5.1. As a consumer you have the right to withdraw from a contract for digital content within 14 days without giving any reason.

5.2. When you buy silver you expressly ask us to supply it immediately and you acknowledge that you lose the right of withdrawal as soon as delivery has begun and has been completed. This notice is shown before every purchase.

5.3. A withdrawal declared before delivery begins can be sent in any clear form, for example: "I hereby withdraw from my contract for the purchase of the following digital content: ... Ordered on: ... Name: ... E-mail or account: ... Date: ...". Send it through the contact form.

5.4. Money paid to the store is refunded through the store. We forward valid withdrawal declarations to the store where this is needed.

6. RULES OF PLAY

6.1. Buildings produce profit per hour. Profit is calculated when you open the profile or the office and is added to the collected balance. Profit that is not collected for 7 days expires.

6.2. Real estate market. A licence (1 000 silver, valid one year) is needed to buy and sell there. A building can be listed once it has been in your portfolio for a month; listing costs 50 silver. An offer expires after 7 days and the building returns to the seller. Deals are concluded between players; we only provide the platform and are not a party to them.

6.3. The taxes in the game are game rules, not state taxes: donation 1 % of the portfolio (1-30 December), regular tax 1.5 % of the portfolio (1-31 January), non-regular tax 2.5 % of the portfolio and the purchase budget (1 February - 30 November). If no tax was paid for a year, a penalty of 10 % of the portfolio and the purchase budget is charged for that year.

6.4. Bank credit is interest-free and no money is paid out. You receive one building of the chosen category. Within 12 months you must buy 12 further buildings of the same category or a higher one, one per month starting on the first day of the following month; a building of a lower category does not count. If you buy all of them earlier, the credit closes early. Only one credit per category. If a monthly purchase is missing, you have 24 hours to correct it; after that a fine equal to the credit amount is charged, the financed building is taken back and the credit line is closed for one month.

6.5. Fortuna and Battle are games of chance played with silver, never with money, and pay out only in silver. The result is drawn by a random generator before the animation. In Fortuna one of 37 fields is drawn: 77 and 11 appear once each (probability 1 in 37 each), the numbers 0, 1, 2, 3 and 4 appear seven times each (probability 7 in 37 each). A win returns your stake doubled, plus 30 silver for 77 or 11. If you bet on the same number between 6 and 35 times in a row, the draw is repeated until it differs from your bet, so during that streak a win is not possible. In Battle you bet on a rising or falling curve which is generated randomly on your device; it represents no exchange, no real market and no real asset. The number of players online and the highs and lows on that screen are decorative.

6.6. Reward videos give 50 silver for a video watched to the end. Availability depends on the advertising network, and we may limit the number of videos per day and per account.

6.7. Referral commission is paid on silver purchases made by players you invited: 10 % from the first level and 1 % from each of levels 2 to 7. It is credited to the referral balance. Your nickname must be entered in the referral field of the invited player. Commission from your own additional accounts, from fake accounts or from unsolicited advertising (spam) is void.

6.8. Competitions are announced in the app. The period, the prize and the conditions are stated in the announcement.

6.9. Bankruptcy: if the purchase budget reaches minus 500 000 silver, the account is closed and you may register again.

7. PAYOUTS

7.1. From 8 000 silver you may request a payout from the payout balance or the referral balance under Payment order.

7.2. The payment details must be correct and belong to you. Before a payout we may ask you to confirm your identity, your age and the origin of the funds; this follows from the rules against fraud and money laundering.

7.3. Payout requests are checked by a person. We aim to process them within 5 working days. Payment providers may charge a fee of 0 % to 6 % depending on the method and the amount; we deduct nothing of our own.

7.4. We may refuse or reverse a payout only if it is based on a breach of these Terms or on a technical error, or if the law requires it. We tell you the reason, and you may object under section 9.

7.5. Any tax on a payout in your country is your own responsibility. We withhold nothing.

8. YOUR OBLIGATIONS

You agree not to use bots, emulators or modified clients; not to exploit software errors, but to report them to us; not to keep several accounts and not to disguise your identity or location with a VPN or a proxy; not to buy, sell or exchange accounts, silver or game items for real money outside the game; not to send unsolicited advertising to other players; not to publish insults, threats, discriminatory, pornographic or otherwise illegal content; and not to interfere with the operation of the game. Keep your login and password secret; you are responsible for actions taken through your account.

9. MEASURES, REASONS, COMPLAINTS

9.1. If you breach these Terms, we may, in proportion to the breach, warn you, revoke silver and items obtained through the breach, restrict single functions, suspend the account or terminate the contract.

9.2. Unless the law forbids it, we tell you what measure was taken, the facts and grounds it is based on, whether automated means were used, and how you can object.

9.3. You may object to any measure free of charge within 6 months through the contact form. The objection is reviewed by a person, not by a machine. If it is justified, we reverse the measure without delay. Your right to go to court or to an out-of-court dispute body under section 13 remains untouched.

9.4. Illegal content or conduct in the game can be reported at any time through the contact form. We deal with such reports promptly and inform the person who reported the outcome.

9.5. We do not remove silver because an account is inactive. If an account is not used for 24 months, we write to you and may close it 30 days later; during that period a payout balance above the minimum can still be requested.

10. AVAILABILITY, UPDATES, CONFORMITY

10.1. We supply the game in the agreed quality for the duration of the contract and provide the updates, including security updates, that are needed to keep it in conformity. Individual functions may be changed or removed for technical, legal or security reasons; significant changes are announced in advance.

10.2. The game may be unavailable temporarily because of maintenance, faults, or events outside our control. We do not guarantee uninterrupted availability.

10.3. If the game is not in conformity with the contract, you have your statutory rights under European Union law on digital content: restoration of conformity, a proportionate price reduction, and termination. Report the defect through the contact form.

10.4. If a technical fault creates silver, items or results that would not exist without it, we may correct the affected accounts. Game outcomes that merely disappointed you are not corrected.

11. LIABILITY

11.1. We are liable without limit for intent and gross negligence, for injury to life, body or health, and wherever liability is mandatory by law.

11.2. For slight negligence we are liable only for the breach of an obligation that is essential to the contract, and only up to the damage typically foreseeable for such a contract.

11.3. We are not liable for silver, items or advantages lost through your own actions, through disclosure of your access data, or through the conduct of other players.

12. DATA PROTECTION

12.1. Personal data is processed as described in the Privacy Policy at buildinvest.online/privacy_policy.

12.2. You have the rights of access, rectification, erasure, restriction of processing, objection and data portability, and the right to complain to a supervisory authority (in Estonia: Andmekaitse Inspektsioon, aki.ee).

12.3. Deleting the account under Support - Contacts removes your login. The game data linked to it is deleted or anonymised within 30 days, except data we are required by law to keep, such as payment records. Deletion is final: silver, buildings and balances are lost and are not paid out.

13. CHANGES, TERM, APPLICABLE LAW, DISPUTES

13.1. We may change these Terms for a valid reason, for example new functions, changes in the law, or security. Changes are announced at least 30 days in advance in the app and, where we have your address, by e-mail, together with a note of what changes. If you do not accept a change, you may terminate the contract before it takes effect at no cost and request a payout of the eligible balances under section 7.

13.2. The contract runs for an indefinite period. You may terminate at any time by deleting your account. We may terminate with 30 days' notice, or immediately for good cause under section 9.

13.3. Estonian law applies. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country in which you live.

13.4. Disputes: please contact us first. Consumers may also turn to the Consumer Disputes Committee in Estonia (Tarbijavaidluste komisjon, tarbijakaitse.ee) or to a dispute resolution body in their own country. We are not obliged to take part in such proceedings and decide case by case. The European ODR platform ceased operation on 20 July 2025. The way to the ordinary courts is always open.

13.5. If a provision is or becomes invalid, the rest of the Terms remains in force.

13.6. These Terms are available in all languages of the app. The English version is the reference version; if you concluded the contract in another language, you may rely on the version in that language.
